When Does a Bail Forfeiture Occur?
Bail forfeiture happens when a defendant doesn’t show up for court. When a defendant misses court on the appointed date and time, a bench warrant is issued by the judge for the defendant’s arrest. At this point, it is often possible for a bail bond to be reissued or reinstated by the defendant, working together with the bail bond agent. When this happens, the court sets a new trial date for the defendant.
